Foreign Subsidies Regulation Notification Tracker
The Foreign Subsidies Regulation (FSR) (Regulation (EU) 2022/2560 on foreign subsidies distorting the internal market) has introduced a wide-ranging set of rules and European Commission powers to prevent financial advantages provided by third countries from distorting competition within the EU internal market. This includes mandatory notification when thresholds are met on the turnover of the companies involved and on the amount of the financial contributions received from third countries.
Is the FSR relevant for your company?
The regulation applies to all companies engaging in economic activity on the EU internal market, regardless of whether the company is private or publicly owned. The actual applicability of the FSR depends on whether all material conditions are met: a company only has to take account of the FSR when it receives a foreign subsidy as defined by the regulation.
