Duties of care: solution or headache?

On 1 January 2024, the Environment and Planning Act (Omgevingswet, or EPA) finally entered into force, after a long legislation process and repeated delays. The EPA can significantly impact the administrative and criminal enforcement of environment and planning law, as it introduces more general rules (instead of permits and permit requirements), more flexibility and more duties of care.

Marianne Bloos, Frank Mattheijer and Luurt Wildeboer discuss several duties of care introduced in the EPA and EPA-based decrees . They also address the potential developments in the administrative and criminal enforcement of some of these new duty of care provisions.
