Cassation Seminar: the Dutch Supreme Court and the anticipated surge in pension litigation

The Future of Pensions Act (Wet toekomst pensioenen) has been in effect since 1 July 2023 and is currently very much in the spotlight. This Act has significant implications for all parties involved in pension schemes. Over the next few years, existing pension schemes will be adjusted in line with the new system. There have been warnings that this transition could lead to a surge in civil proceedings. Undoubtedly, the transition will raise complex questions. How will our highest court of justice respond?

The seminar begins with previous Supreme Court pensions case law. We will discuss the lessons learned from the Supreme Court's handling of newly introduced legislation in the adjacent field of employment law.

During an interactive panel discussion, speakers from legal practice will addressing the role that the Supreme Court can and should play in future pension litigation.
